Privacy policy

Last updated: October 17, 2026

1. Who we are

This Privacy Policy (“Policy”) explains how FairAI, Inc., a Delaware corporation, United States of America (“FairAI”, “we”, “us” or “our”), collects, uses, shares and stores personal data when you visit the website getfair.ai (the “Website”) or contact us through it.

FairAI is the controller of the personal data described in this Policy. For any question about this Policy or about how we handle your personal data, contact us at [email protected].

This Policy is designed to comply with the laws that apply to the Website, including Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (the General Data Protection Regulation, “GDPR”).

2. Personal data we collect

You can browse the Website without giving us any personal data. We do not operate user accounts on the Website. We only process the following data:

a) Contact form

When you send us a message through the contact form, we collect your name, your company name (if you provide it), your email address and the content of your message. The form is delivered to us through the EmailJS service.

b) Meeting scheduling

The scheduling calendar only loads when you open the booking page or ask for it. If you book a meeting, the booking is made directly on the Calendly service, which collects the details you enter (such as your name, email address and any notes) and shares them with us so we can hold the meeting.

c) Correspondence

We receive the information you send us directly, for example by email or through our LinkedIn page.

d) Usage statistics

We use Plausible, a privacy-friendly analytics tool that does not use cookies, to produce aggregate statistics about how the Website is used (for example, pages visited, referring website, browser, operating system, device type and country). These statistics do not allow us to identify individual visitors.

e) Technical data

When you visit the Website, your browser necessarily sends technical data such as your IP address to our hosting and content delivery provider (Cloudflare). This data is used to deliver the Website, keep it secure and prevent abuse. The Website serves its own fonts and images.

3. Cookies and browser storage

FairAI does not use cookies on the Website. If you close the suggestion to view the Website in another language, we store that choice in your browser's session storage so it is not shown again during your visit. This information never leaves your device and is deleted when you close your browser.

To tailor the Website to your sector and prepare the call, we store in your browser's local storage the sector you chose and a summary of what you did on the Website: the steps you looked at, the one you marked as most important, the values you entered in the calculator and your answers to the quick assessment. This information stays on your device and only reaches us if you send it: it appears pre-filled in the booking and in the message, where you can change or delete it, and you can clear it at any time on the booking page or by deleting the Website's data in your browser.

The scheduling calendar is provided by Calendly and may set its own cookies when it loads. For more information, see Calendly's cookie and privacy notices.

4. Why we use your data and on what legal basis

  • To answer your enquiries, schedule meetings and prepare proposals or demonstrations: to take steps at your request before entering into a contract (Article 6(1)(b) GDPR) or, for general enquiries, our legitimate interest in responding to people who contact us (Article 6(1)(f) GDPR).
  • To improve the Website using aggregate statistics: our legitimate interest in understanding how the Website is used (Article 6(1)(f) GDPR).
  • To deliver the Website and keep it secure, including preventing fraud and abuse: our legitimate interest in operating a secure website (Article 6(1)(f) GDPR).
  • To comply with legal obligations, including requests from competent authorities (Article 6(1)(c) GDPR).
  • To protect our rights, including establishing, exercising or defending legal claims: our legitimate interest (Article 6(1)(f) GDPR).

Where we rely on legitimate interests, you have the right to object at any time (see section 9). We do not use your data for automated decision-making or profiling, and we do not sell your personal data.

5. Who we share data with

We share personal data only as needed for the purposes above:

  • Service providers that process data on our behalf and under our instructions: EmailJS (contact form delivery), Calendly (meeting scheduling), Cloudflare (hosting and content delivery) and Plausible (aggregate analytics), as well as the email and productivity tools we use to receive and manage your messages.
  • Authorities and advisers, where required by law, court order or other legal process, or where necessary to establish, exercise or defend legal claims.
  • A successor business, in the event of a merger, acquisition, reorganisation or sale of all or part of our business, which will be bound by this Policy.

6. International transfers

FairAI is based in the United States, and some of our service providers process data outside the European Economic Area (EEA). Where personal data is transferred outside the EEA, we rely on an adequacy decision of the European Commission (including, where applicable, the EU-U.S. Data Privacy Framework) or on the standard contractual clauses approved by the European Commission, in accordance with Articles 45 and 46 GDPR.

7. How long we keep your data

We keep contact form messages, meeting bookings and related correspondence for as long as needed to handle your request and any resulting business relationship, and in any case for no longer than 24 months after our last interaction with you, unless a longer period is required by law or needed to establish, exercise or defend legal claims. If you become a client, the data needed to manage that relationship is kept for the duration of the contract and afterwards for the periods required by law. Usage statistics are aggregate and contain no personal data.

8. Security

We use appropriate technical and organisational measures to protect personal data against loss, misuse, unauthorised access, disclosure, alteration and destruction. However, no transmission over the Internet is completely secure, and we cannot guarantee absolute security.

9. Your rights

Under the GDPR you have the right to:

  • access your personal data and obtain a copy of it;
  • have inaccurate or incomplete data corrected;
  • have your data erased;
  • restrict the processing of your data;
  • object to processing based on our legitimate interests;
  • receive your data in a portable format;
  • withdraw your consent at any time, where processing is based on consent, without affecting processing carried out before withdrawal;
  • lodge a complaint with a supervisory authority, in particular in the EU Member State where you live or work; in Portugal, the Comissão Nacional de Proteção de Dados (CNPD, www.cnpd.pt).

To exercise these rights, email [email protected]. We will reply within one month of receiving your request. This period may be extended by two further months where necessary, taking into account the complexity and number of requests, in which case we will tell you. We may ask for information to confirm your identity.

10. Children

The Website and our services are intended for businesses and professionals and are not directed at children. We do not knowingly collect personal data from anyone under 18. If you believe a child has provided us with personal data, contact us and we will delete it.

11. Third-party websites

The Website contains links to third-party websites and services (such as LinkedIn and the websites of the companies and organisations shown on the Website). We are not responsible for how those third parties handle personal data; please read their own privacy policies.

12. Changes to this Policy

We may update this Policy from time to time to reflect changes in the law or in how the Website works. The updated version will be published on this page with a new “last updated” date. If the changes are significant, we will make reasonable efforts to inform you.
